Air Traffic Controllers Union Sues Trump Admin. Over Gov. Shutdown, Claims Rights Violations – Fox News Insider

The union representing air traffic controllers across the country is suing President Trump’s administration over making employees work without pay.

As the partial government shutdown reached its third week, thousands of controllers are among the hundreds of thousands of furloughed workers nationwide.

Fox 61 reported that the National Air Traffic Controllers Association filed its suit on Friday, claiming that the shutdown violates employees’ constitutional rights.

“We’re calling it a violation of the Fifth Amendment,” said Mick Devine, the union’s New England regional vice president.

Oliver McGee, former deputy assistant secretary of transportation, said Saturday on Fox & Friends that the lawsuit is a bad move.

“The government always pays its bills,” he said, “and they will furlough after this government-shutdown drama is over.”

He said that it’s still safe to fly, even though controllers won’t be getting paid.

“These folks are very dedicated to their jobs,” he said. “So are the TSA security officers. … This drama will end and more importantly, the courts will back the president on this because of the Taft-Hartley Act and that the government will be paying its bills.”

The Taft-Hartley Act of 1947 prohibits unions from going on certain strikes and boycotts.
